Debt recovery in Malaysia
Dealing with unpaid debts can be a challenging and time-consuming process. At P. Gunalan & Co., we understand the complexities involved in debt recovery and offer our expertise to help you navigate the legal landscape effectively. Here’s an overview of the debt recovery process in Malaysia and how we can assist you in reclaiming what is rightfully yours.
Understanding Debt Recovery
Debt recovery involves a series of legal steps to recover money owed by individuals or companies. The process is designed to ensure that creditors can enforce their rights and collect outstanding debts efficiently. Here are the key stages involved in debt recovery:
Initial Steps in Debt Recovery
Research and Preparation:
Identify the debtor and verify whether they are an individual or a company. Conduct background checks to ascertain their financial status and any previous bankruptcies. For individuals, use the National Registration Department (NRD) and for companies, use the Companies Commission of Malaysia (CCM).
Collect all relevant evidence, such as contracts, invoices, emails, and other communications that substantiate the debt.
Letter of Demand (LOD):
This is typically the first formal step, although not mandatory. It serves as a notice to the debtor demanding payment and outlining the consequences of non-payment. It sets a deadline for payment and warns of potential legal action.
Legal Action for Debt Recovery
Filing a Lawsuit:
If the debtor does not respond to the LOD, legal proceedings can be initiated. The court in which you file depends on the amount owed:
Magistrate Court: For debts below RM100,000.
Sessions Court: For debts between RM100,000 and RM1,000,000.
High Court: For debts over RM1,000,000.
The process involves filing a writ and a statement of claim, which must be served to the debtor, now the defendant.
Obtaining a Judgment:
If the debtor does not respond, a judgment can be obtained by default. Alternatively, a summary judgment can be sought if the evidence is clear or has no valid defense, avoiding a full trial.
Enforcing the Judgment
Execution of Judgment:
Garnishee Proceedings: These involve collecting the debt from third parties who owe money to the debtor, such as bank accounts.
Writ of Seizure and Sale: This allows for the seizure and auction of the debtor’s movable or immovable property to recover the debt.
Bankruptcy Proceedings: If the debt exceeds RM100,000, bankruptcy proceedings can be initiated against the debtor.
Winding-up Petition: Applicable for companies, this involves liquidating the company's assets to pay off the debt if it owes more than RM50,000.
Judgment Debtor Summons (JDS):
This compels the debtor to appear in court to disclose their financial status and assets. Non-compliance can lead to arrest and further legal consequences.
Debt recovery in Malaysia requires careful navigation of legal procedures, and creditors are advised to seek legal counsel to maximize their chances of successfully recovering debts.
